Mitigate unsecure data transfers out of the Bailiwick

The Bailiwick of Guernsey is well-regarded as a safe place to do business, which inevitably involves the sharing of personal data. However, when it comes to transferring data out of the islands, safety and security becomes a concern.
The Office of the Data Protection Authority (OPDA) has recently launched new guidance on data transfers for this very scenario, highlighting how businesses and individuals can best protect themselves, the data they transfer and the subjects who that data relates to. The Bailiwick maintains a high standard of protection of people’s data, echoing the General Data Protection Regulation (GDPR), which the rest of Europe abides by.
Taking a look at the new guidance is a worthwhile exercise, particularly if you’re unsure how an off-island data transfer works. Remember the data you hold is your responsibility, including knowing its value, where it is located, where it is accessed from, which regulatory and compliance elements apply, and how confidentiality, integrity and availability is maintained regardless of whether you insource, or use a cloud, managed service or outsourcing partner. Penalties for personal data protection breaches can be hefty, so it is important to stay on top of the latest regulations.
